Terms of Service

Welcome to xView (the “App”), which is provided by RZG Labs Dijital Limited (“RZG Labs”, “we” or “us”).

By accessing or using our app, xView or any of our related applications, products, services and content (collectively, the “Services”), you agree to the terms of service (the “Terms”). If you do not agree to these Terms, you must not use or access the Services.

Your access to and use of our Services is also subject to our Privacy Policy, the terms of which can be found directly on the App, or where the App is made available for download, on your mobile device’s applicable app store, and are incorporated herein by reference. By using the Services, you consent to the terms of the Privacy Policy.

The Terms form a legally binding agreement between you and us. Please take the time to read them carefully.

Basic Terms

By using the Services, you agree that:

  1. You will not access or use the Services if you are not fully able and legally competent to agree to these Terms.
  2. You will not access or use the Services for any purpose that is illegal or prohibited in these Terms.
  3. You will not use any robot, spider, crawler, scraper, or other automated means or interface to access the Services.
  4. You will not use or develop any third-party applications that interact with the Services or other users’ content or information without our written consent.
  5. You will not use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services.
  6. You will not use or attempt to use another user’s account, username, or password without their permission.
  7. You will not share your password.
  8. You will not solicit login credentials from another user.
  9. You will not log in or attempt to access the Services through unauthorized third-party applications or clients.
  10. You will not use automated scripts to collect information from or otherwise interact with the Services.
  11. You will not probe, scan, or test the vulnerability of our Services or any system or network.
  12. You must not transmit any worms or viruses or any code of a destructive nature.

Conditions

  1. We reserve the right to modify or terminate the Service for any reason, without notice at any time.
  2. We reserve the right to refuse Service to anyone for any reason at any time.
  3. We reserve the right to force forfeiture of any username that becomes inactive, violates trademark, or may mislead other users.
  4. We reserve the right to request you to provide information to verify your identity (including your first and last name and your ID number).
  5. We reserve all rights not expressly granted to you.

Use License

a. Permission is granted to temporarily download one copy of xView per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy the materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained in xView;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or "mirror" the materials on any other server.

b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by RZG Labs at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Payments

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription. At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it at least 24 hours before the end of your current subscription or RZG Labs cancels it.

Refunds

Purchases of Subscriptions are non-refundable and non-transferable, even if they expire or are discontinued. We may change the purchase price for Subscriptions at any time, as well as the features included in Subscriptions. We reserve the right to stop issuing Subscriptions at any time and to set expiration dates for Subscriptions. Subscriptions may not be redeemed for any sum of money or monetary value.

Certain refund requests for Subscriptions may be considered by RZG Labs on a case-by-case basis and granted in sole discretion of RZG Labs.

Accuracy of Materials

The materials appearing in xView could include technical, typographical, or photographic errors. RZG Labs does not warrant that any of the materials on xView are accurate, complete or current. RZG Labs may make changes to the materials contained in xView at any time without notice. However RZG Labs does not make any commitment to update the materials.

Limitation of Liability

RZG Labs and our affiliates, directors, officers, stockholders, employees, licensors, suppliers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from: (a) your use of the Services or inability to use the Services; (b) your access to or inability to access the Services; (c) the conduct or content of other users or third parties on or through the Services; or (d) unauthorised access, use or alteration of your content.

IF THE LAW OF THE COUNTRY WHERE YOU LIVE DOES NOT ALLOW ANY LIMITATION OF LIABILITY PROVIDED FOR IN THIS CLAUSE, THAT LIMITATION WILL NOT APPLY.

Indemnity

You agree, to the extent permitted by law, to indemnify, defend, and hold harmless RZG Labs, our affiliates, directors, officers, stockholders, employees, licensors, and agents from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneys’ fees) due to, arising out of, or relating in any way to: (a) your access to or use of the Services; (b) your content; and (c) your breach of these Terms.

Disclaimers

The materials within xView are provided on an 'as is' basis. RZG Labs makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, RZG Labs does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to xView.

Other Terms

Changes to the Terms

We amend these Terms from time to time, for instance when we update the functionality of our Services or when there are regulatory changes. We will use commercially reasonable efforts to generally notify all users of any material changes to these Terms, such as through a notice on our App, however, you should look at the Terms regularly to check for such changes. We will also update the “Last Updated” date at the top of these Terms, which reflect the effective date of such Terms. Your continued access or use of the Services after the date of the new Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop accessing or using the Services.

Entire Agreement

These Terms constitute the whole legal agreement between you and RZG Labs and govern your use of the Services and completely replace any prior agreements between you and RZG Labs in relation to the Services.

Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey and you irrevocably submit to the exclusive jurisdiction of the courts in Turkey.

Age Limit

The Services are only for people 13 years old and over. By using the Services, you confirm that you are over the relevant age specified herein.

Links

RZG Labs has not reviewed all of the sites linked to its App and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by RZG Labs of the site. Use of any such linked website is at the user's own risk.

No Waiver

Our failure to insist upon or enforce any provision of these Terms shall not be construed as a waiver of any provision or right.

Security

We do not guarantee that our Services will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our Services. You should use your own virus protection software.

Severability

If any court of law, having jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms, and the remaining provisions of the Terms will continue to be valid and enforceable.
